Nepal Bar Warns Government: Resistance Imminent if Constitutional Integrity is Compromised

Addressing the National Conference of Women Lawyers in Bhaktapur, Prof. Dr. Bijay Prasad Mishra, President of the Nepal Bar Association (NBA), cautioned the two-thirds majority government against any attempts to undermine judicial independence. He pointed out a recurring historical trend where governments with absolute power have systematically targeted the judiciary. While the NBA is currently granting the new administration the “benefit of doubt” and wishes for it to complete its full five-year term, Dr. Mishra emphasized that this support is strictly conditional upon the government’s adherence to the principles of constitutionalism and the rule of law.

To underscore his concerns, Dr. Mishra revisited dark chapters of Nepal’s legal history, citing the 1959 removal of Chief Justice Hari Prasad Pradhan, the 1960 imprisonment of judges, and the 1991 political interference in judicial appointments. He asserted that the Bar’s duty to protect the sanctity of the courts is a legacy passed down by their predecessors. Recalling the heavy price paid during previous democratic movements—including arson attacks on law firms and bombings at the NBA premises—he declared that the legal fraternity remains prepared to take a firm stand and face any consequences to prevent the erosion of the judicial system.
