The joint bench of Justices Nahakul Subedi and Sunil Kumar Pokharel directed that no major decisions be made by the cabinet, reportedly formed on Kartik 23. The order noted serious concerns regarding parliamentary democracy and transparency in the appointment process and warned against taking any steps until the matter is resolved.

The court also cautioned against actions contrary to parliamentary practice during the confidence vote process under Article 16(4) of the Constitution. The final hearing of the petition filed by opposition members, including Congress parliamentary leader Krishna Prasad Yadav, is scheduled for Mangsir 11.

Seventy-four members of the Madhesh Provincial Assembly have petitioned the Supreme Court to annul the provincial chief’s decision to appoint UML parliamentary leader Saroj Kumar Yadav as Chief Minister.
