The Supreme Court has once again postponed the hearing on the petition filed against the appointment of Madhesh Province Chief Minister Saroj Kumar Yadav.
The case was scheduled before the joint bench of Justices Til Prasad Shrestha and Nripadhwaj Niraula, but the hearing could not proceed because the written response from the Province Chief was not submitted through the Office of the Attorney General, as required by law.
Earlier, the Court had sought a written reply from the Province Chief, and the next date for the interim order hearing has now been fixed for Mangsir 1. The Court has instructed that all written responses must be routed through the Attorney General’s Office.
A group of 74 provincial lawmakers filed the petition, arguing that the government formed under Article 168(3) was unconstitutional, as Article 168(2) was still applicable. In a separate petition against Yadav, the Supreme Court has already ordered him not to make any long-term or impactful decisions.
Another petition filed by Rakki Prasad Sah and Sujit Yadav claims the Province Chief appointed Yadav unconstitutionally and seeks to annul the appointment.
The controversy has already led to the removal of Province Chief Sumitra Subedi Bhandari.
