Kathmandu-The Cyber Bureau is preparing to arrest Swagat Nepal, an advocate and spokesperson for the Royalist Movement, on charges of spreading misinformation against Prime Minister Sushila Karki.

According to Nepal, the police called him on Monday and requested that he appear at the bureau. He shared that the officer mentioned the ongoing Tihar festival, saying, “It’s Tihar, will you be celebrating?” Nepal replied, “If I’m allowed to receive tika from my sisters, I will. Today is Laxmi Puja, but if I must come, I’ll come.” The officer reportedly told him to celebrate Tihar first.

Advocate Nepal has repeatedly stated that under Nepal’s Constitution, a former Chief Justice cannot hold an executive position such as Prime Minister. He said, “In contradiction to her own statement and decision, she became Prime Minister from outside the constitutional framework after being a former Chief Justice and MP. This is one of the greatest moral wrongs in the world.”

He further argued that he has always raised questions about morality when constitutional violations occurred under various prime ministers, claiming that he was arrested for speaking the truth. “When citizens raise legitimate demands, instead of correcting themselves, the government imposes authoritarianism — that’s why the protests intensified,” he added.

Nepal also reiterated that he would once again raise the issue of Prime Minister Sushila Karki allegedly exposing a corruption case involving Rs 100 million.

As per Article 76 of Nepal’s Constitution, a non-parliamentarian cannot be appointed as Prime Minister. Similarly, Article 132 (2) clearly states that a person who has served as Chief Justice or Justice of the Supreme Court shall not be eligible for appointment to any government position, except as otherwise provided in the Constitution.

Swagat Nepal, who is a lawyer by profession, also serves as the spokesperson of the Royalist Movement. He was previously arrested on 15 Chaitra during a royalist demonstration.
